Judicial Panel to Reexamine Decision That Permitted Trump to Deploy Troops to Oregon City

Appeals Court Concurs to Reconsider Legal Matter

The federal appeals court decided on this week that it would reexamine the legal dispute concerning the president’s authority with an expanded panel of eleven justices. The court also vacated a previous ruling from a three-judge panel that had sided with the federal government.

Legal Saga Over Military Presence

This order represents the most recent turn in a protracted legal battle over whether the administration has the authority and justification to deploy national guard forces in Portland. Approximately 200 federalized guard members have been in limbo since the end of September when the mobilization attempt was initiated in due to ongoing demonstrations.

Differing Viewpoints

The federal government has argued that government employees at the ICE facility in south Portland were under attack, while city and state officials maintain that municipal police have command of the circumstances.

Contrary to descriptions of the city as “war ravaged”, residents have been sharing videos of lush hiking trails and a thriving food scene, and organizing events such as an protest bicycle event against the increased military presence.

Recent Legal Actions

The appeals court decision came after a federal judge in Portland issued two temporary restraining orders this month – one preventing the federalization of the state troops, and another stopping the deployment of any national guard troops in the state, after efforts to evade the initial injunction by mobilizing out-of-state forces.

On Monday, the appeals court had put the first ruling on hold – permitting command of state troops – but the subsequent injunction stayed effective, preventing the physical sending of the forces.

The Tuesday decision means the matter will be heard by the full court – with both rulings under consideration together – by a group of eleven justices.

“This ruling shows that facts are important and that the judicial system are working to ensure government responsibility. The constitution limits the president’s power, and local populations cannot be treated as a testing site for expansive government power,” stated the legal representative in a statement.

“The court is sending a clear message: the president cannot send the armed forces into American urban areas unnecessarily. We will continue protecting Oregon’s laws, values, and autonomy as this legal proceeding progresses and our legal battle continues in the courts.”
